A Short-Term Appointment is used to recruit staff to meet short-term needs. The duration of this assignment is provided above. The maximum duration of a short-term appointment including extensions shall not exceed 12 months.
A Short-Term Appointment does not carry any expectancy, legal or otherwise, of renewal and shall not be converted to any other type of appointment.
Due to the short-term nature of the assignment, the ICC reserves the right to make an appointment at one grade lower than that stated in the vacancy with a modified job description.
A current ICC staff member who is holding a fixed-term appointment may apply for any short-term position. Where a current ICC staff member is selected to a short-term position, he or she will be temporarily assigned to the position in line with section 4.10 of ICC/AI/2016/001. GS-level posts are subject to local recruitment only.
The terms and conditions of service for staff members appointed under a short-term appointment are governed by ICC/AI/2016/001.
Organisational Context The Office of the Prosecutor investigates and prosecutes genocide, crimes against humanity, war crimes and the crime of aggression committed by nationals of or on the territory of a State Party under the Court’s jurisdiction on or after 1 July 2002. The Legal Advisory Section (LAS) working with other parts of the OTP as necessary, responds to requests for legal advice from the Prosecutor, the Deputy Prosecutors and other components of the Office. These requests concern the OTP’s investigations and prosecutions, core operations, the general functioning of the OTP as an independent organ, Administrative law and other relevant internal matters. LAS also facilitates the establishment and maintenance of the professional and ethical standards of the Office, coordinates the development of the Office’s internal regulatory framework, including the Operations Manual, and maintains the Office’s Code of Conduct. Further, it leads the development, implementation and revision of OTP policies on key issues identified by the Prosecutor.. The Section also assists the Prosecutor and participates in the development and revision of Court-wide policies and administrative issuances as well as other broader aspects of the Regulatory framework. The Section provides expert advice, drafting and revision of Memoranda of Understanding between the Office and relevant stakeholders as well as providing expert input on the procurement review and secondment process. Finally, LAS is responsible for identification of lessons learned so as to enhance the functionality and efficiency of the function. It manages the maintenance and development of on-line legal tools, commentaries and databases for the Office, on which it also provides trainings, and the development and maintenance of a legal-academic network for the Office, including a series of Guest Lectures by external experts. Duties and Responsibilities Under the supervision of the Senior Legal Advisor or a Legal Advisor and in close collaboration with other members of the Section, where needed, the incumbent will perform the following duties: Drafting legal opinions and undertaking research and studies and examining legal precedents on a wide variety of legal problems relating to the functions, structure and activities of the Office of the Prosecutor or the Court. Provide legal advice on staff related matters under the Court’s legal framework and drafting in relation to litigation in individual staff cases, including for the representation of the Prosecutor in internal and international administrative proceedings; Provide legal advice and drafting on contracts, Memoranda of Understanding (MoU) and other agreements and arrangements which may be concluded between the Office and external partners; Provide legal advice and drafting on internal regulatory documents, both within the Office and, on behalf of the Office, on Court-wide instruments; Contribute to the development of Office policies by conducting research, analysis and drafting of other legal and policy documents, upon request; and Perform any other duties as required. Essential Qualifications Education: Advanced university degree in law, preferably with a specialisation in international law, administrative/labour law or international institutional law, is required. A first-level university degree, in combination with two additional years of qualifying experience is accepted in lieu of the advanced university degree. Bar admission or equivalent (e.g. solicitor), with post-qualification experience, would be considered an asset. Experience: A minimum of two years of professional experience (four years with a first-level university degree) relevant to the duties and responsibilities mentioned in the present Vacancy Announcement as a lawyer or legal advisor, is required. Relevant professional experience within an intergovernmental organization or equivalent legal experience in a government, law firm, non-governmental organization or academia is highly desirable. Expertise or experience with regard to international law, administrative/labour law, international institutional law, litigation, contracts , MoUs, and/or agreements will be considered an asset. Knowledge, Skills and Abilities: Excellent legal drafting skills; Ability to communicate clearly and effectively orally and in writing; Ability to keep strict standards of confidentiality and security of information; Ability to work effectively under strict deadlines; Ability to render advice which is both legally correct and pragmatic, and thus can easily be incorporated into the Office’s policies and litigation; Ability to work effectively and constructively in teams comprising members from a broad range of backgrounds, legal systems and professions; Be able to adapt to multicultural and multilingual working environments; Personal and professional integrity. Knowledge of Languages: Proficiency in one of the working languages of the Court, English or French is required. Working knowledge of the other language is highly desirable. Knowledge of another official language of the Court (Arabic, Chinese, Russian, Spanish) would be considered as an additional asset. ICC Leadership Competencies
